(People ex rel. Graves v. McFadden, People ex rel. Graves v. County of Orange, People ex rel. Graves V. County of Orange et al., 81 Cal. 489.) 304. Whether a general law can be made applicable depends upon questions of fact, of which the legislature is the exclusive judge. The policy of creating a new county and fixing its boundaries is to be determined by the legislature alone. (People ex rel. Graves v. McFadden, People ex rel. Graves v. County of Orange, People ex rel. Graves v. County of Orange et al., 81 Cal. 489.) Act forming new county, which depends upon vote oi the people, constitutionality of. See ante, 224. New county, special law for holding election for creation of. See Counties, 6. 305. It seems that the act consolidating the city and countgof San Francisco is not unconstitutional. ( eople v. Error in act consolidating city and county of San Francisco, which defeats the first election held under it in that portion of the original county excluded from the consolidation, is not of itself suflicient to warrant a decision that the whole act is unconstitutional, especiallg when the legislature is in session to reme y the defect.
